ADA Compliance Course

The ADA Compliance Course is our course that is specifically designed to prevent website accessibility lawsuits.

What we’ve done is researched accessibility issues claimed in complaints filed in state and federal court by all of the most active plaintiffs’ law firms and then explained exactly how to find and fix each issue.

After looking through hundreds of complaints, we found that there are 15 accessibility issues that come up over and over again. Every so often another issue will come up, but mostly it’s the same 15 issues that are recycled through.

The ADA Compliance Course dedicates a lesson to each of the 15 most commonly claimed issues and then provides step-by-step, detailed instructions on how to find and fix each issue. For more technically advanced issues, the instructions include model code examples for your developer to work from.

Use Cases

Website Owner/Operator: A Shopify ecommerce website owner takes this course to learn exactly what needs to be done to avoid being sued (again). The owner tells their web developer to follow the instructions in the exact order that shows up in the lessons.

Defense Attorney: A defense attorney signs up to learn the technical side of the accessibility issues being claimed against their current and future clients. The attorney uses the information to better defend their clients, undermine some of the claims made, and negotiate lower settlement amounts.

Web Agency: A web design agency purchases the course because their clients are getting sued. The agency implements the recommendations into their website creation processes to immediately lower risk for their clients.

Industry Problems

The website accessibility industry is fraught with products and services that don’t actually help website owners stop lawsuits. Some of the largest digital accessibility companies have corporate clients that have been sued repeatedly despite paying tens of thousands of dollars on an annual subscription for years.

Moreover, multiple vendors present automated scans as a solution to ADA website compliance, acknowledging but downplaying the role of manual effort when manual work is almost everything. While eliminating scan errors has always been a best practice, website accessibility lawsuits have evolved far beyond issues flagged by scans.

And, obviously, overlay widget sellers have deceived website owners for years, marketing their widget as a “solution” to ADA compliance and WCAG conformance despite the fact customers were getting sued with their widgets installed.

The reality is, to prevent lawsuits, you must prioritize the issues that are most likely to lead to a lawsuit and then manually find and fix those issues. And the fix must be implemented correctly.

Audit and Remediation

A complete audit and remediation is the best path to ensuring your website is fully WCAG 2.1 AA conformant and, basically, bulletproof against claims. However, there are a few drawbacks:

  • Some sellers have poor quality audits that miss issues
  • Audits generally take a month to complete
  • Audits quickly lose value if immediate action is not taken to fix issues
  • Audits do not prioritize issues by legal risk
  • The remediation process can take months to finish
  • Remediation must be completed correctly or issues will remain

Moving Forward

The ADA Compliance Course does not cover all WCAG 2.1 AA accessibility issues. The course was not designed for comprehensive accessibility, but, rather, a focus on the accessibility issues that plaintiffs’ lawyers are focusing on.

Additionally, the course primes website owners for immediate action and an aggressive approach to accessibility because time is of the essence.
