Privacy Policy

This Privacy Policy (“Policy”) describes how Accessible.org, LLC, a Texas limited liability company (“Accessible.org,” “we,” “us,” or “our”), collects, uses, stores, shares, and protects information in connection with the website Accessible.org, AccessibilityTracker.com, AccessibilityBase.com, The ADA Book, and any related websites, platforms, applications, tools, and services operated by Accessible.org (collectively, the “Properties”). “You” refers to any individual or entity that accesses, uses, or interacts with any of the Properties.

By accessing or using any of the Properties, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree with this Policy, you must immediately discontinue use of all Properties. This Policy is incorporated into and subject to our Terms and Conditions. In the event of a conflict, the Terms and Conditions shall control.

Accessible.org reserves the right to update or modify this Policy at any time without prior notice. Changes become effective upon posting to the applicable Property. Your continued use of any Property following modifications constitutes acceptance of the revised Policy. It is your responsibility to review this Policy periodically.

Nature of Our Services and Data Practices

Accessible.org is a digital accessibility company that provides accessibility auditing, remediation, consulting, training, and related technical services. It is important to understand the nature of the data we handle in the course of our work.

In performing our services, we work with publicly available website and application interfaces, source code, documents, screenshots, accessibility issue descriptions, WCAG success criteria evaluations, and related technical information provided by or on behalf of our clients. The focus of our work is identifying and resolving accessibility barriers in digital properties.

We do not request, collect, or process client customer data, end-user personal information, protected health information, financial records, authentication credentials, trade secrets, or other categories of sensitive personal data in the ordinary course of performing our services. If a client inadvertently provides sensitive data outside the scope of an engagement, we will promptly notify the client and delete or return such data. The data we handle in connection with client engagements is limited to the technical, accessibility-related information within the scope of the applicable Services Agreement.

This distinction is relevant throughout this Policy: the categories of information we collect from you as a visitor or account holder on our Properties (described below) are separate from the technical, accessibility-focused data we work with when performing services for clients.

Information We Collect

Information You Provide Directly

We collect information that you voluntarily submit to us through the Properties, including but not limited to: name, email address, phone number, company or organization name, billing and payment information, website URLs and digital asset information submitted for audit or remediation, account registration details on AccessibilityTracker or Accessibility Base, contact form submissions, email inquiries, content submitted through application or listing forms on Accessibility Base, and any other information you choose to provide in connection with your use of the Properties or engagement with our services.

Information Collected Automatically

When you access the Properties, certain information is collected automatically, including but not limited to: anonymized IP addresses, approximate geographic location (country, region, or city), browser type and version, device type and operating system, referring URL or source, pages visited and duration of visit, and general usage patterns across the Properties.

We use Clicky (clicky.com) as our primary analytics provider. Clicky is configured with its visitor privacy feature enabled for all visitors, which means IP addresses are anonymized, no tracking cookies are set, and visitors may opt out through Clicky’s service-wide opt-out system.

We do not use social media tracking pixels, retargeting tools, or behavioral advertising technologies on the Properties. If third-party embeds (such as embedded videos) are present on any Property, those third parties may collect information according to their own privacy policies, which are outside of our control.

Payment Information

Payments are processed through third-party payment processors including but not limited to PayPal and Stripe. Accessible.org does not directly store your full credit card number, bank account information, or other sensitive financial data. Payment processors handle your financial information in accordance with their own privacy policies and applicable data security standards including PCI-DSS.

Information from Service Engagements

When you engage Accessible.org for professional services such as audits, remediation, VPAT/ACR creation, consulting, or training, we receive access to your website, application, digital properties, source code, documents, and related technical information as necessary to perform the requested services. As described above, this information is limited to accessibility-related technical data within the defined scope of the engagement. We do not access, request, or store client customer databases, end-user personal information, analytics or tracking data belonging to the client, or other data unrelated to the accessibility evaluation. This engagement-related information is treated as Confidential Information as defined in the applicable Services Agreement.

How We Use Your Information

We use collected information for the following purposes: to provide, maintain, and improve the Properties and our services; to process transactions, invoices, and payments; to communicate with you about services, inquiries, and account-related matters; to perform accessibility audits, remediation, consulting, training, and related services; to manage your account on AccessibilityTracker, Accessibility Base, or other Properties; to analyze usage trends and improve the functionality and user experience of the Properties; to comply with legal obligations, enforce our Terms and Conditions, and protect the rights, property, and safety of Accessible.org, our clients, and the public; and to send service-related communications necessary for the performance of our obligations.

We do not sell, rent, or lease your personal information to third parties. We do not use your information for behavioral advertising or ad targeting.

Use of Artificial Intelligence

Accessible.org uses artificial intelligence (“AI”) tools and technologies, including third-party AI services, in the performance of certain business operations and client services. This may include but is not limited to: processing, analyzing, or generating content related to accessibility audits, reports, remediation recommendations, training materials, VPATs, ACRs, and other deliverables; drafting, reviewing, or processing communications and documents; analyzing accessibility issues and generating remediation guidance; and supporting internal business operations including content creation and workflow automation.

As described in the “Nature of Our Services and Data Practices” section above, the data that may be processed through AI tools in connection with client engagements is limited to technical, accessibility-related information such as source code, accessibility issue descriptions, WCAG evaluations, screenshots, and remediation recommendations. We do not process client customer data, end-user personal information, protected health information, financial records, authentication credentials, or other categories of sensitive personal data through AI tools.

When such data is submitted to third-party AI service providers in connection with the performance of services, that data is processed in accordance with the applicable AI provider’s terms of service and privacy policy, not this Policy. Accessible.org selects AI service providers whose terms prohibit the use of input data for model training and whose data handling practices are consistent with our confidentiality obligations, but Accessible.org does not control and cannot guarantee the data practices of third-party AI providers. Accessible.org does not independently use client data to train, fine-tune, or improve any AI models.

Client data submitted through AI tools in connection with a services engagement remains subject to the confidentiality obligations in the applicable Services Agreement as between you and Accessible.org. AI-assisted outputs delivered as part of client engagements are reviewed by qualified Accessible.org personnel.

You acknowledge and agree that Accessible.org may use AI tools as described above in connection with your use of the Properties and any services provided to you, and that such use may involve the transmission of technical, accessibility-related data to third-party AI service providers whose data practices are governed by their own terms and policies. How We Share Your Information

Accessible.org does not sell your personal information. We may share information in the following limited circumstances.

Service Providers and Contractors

We engage contractors and service providers who perform functions on our behalf, including but not limited to accessibility auditing, remediation, software development, and administrative support. All contractors and service providers who may access client data or confidential information are bound by written confidentiality obligations at least as protective as those in our client Services Agreements. Contractors and service providers are permitted to access only the information necessary to perform their assigned duties and are prohibited from using such information for any other purpose. As described above, the information contractors access in connection with client engagements is limited to technical, accessibility-related data within the scope of the applicable engagement.

Payment Processors

We share billing and payment information with third-party payment processors (including PayPal and Stripe) solely for the purpose of processing transactions. These processors handle your financial data under their own privacy policies and security standards.

Analytics Providers

Anonymized, non-personally-identifiable usage data is processed by Clicky in accordance with its privacy policy and our privacy-first configuration.

We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Accessible.org, our clients, or the public, or to enforce our Terms and Conditions.

Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

We do not share, disclose, or transfer client data submitted in connection with a services engagement (including but not limited to audit reports, remediation findings, website URLs, source code, and digital asset information) except as required to perform the services, as required by law, or with your prior written consent.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal obligations, to resolve disputes, and to enforce our agreements. Specifically: account information is retained for the duration of your account and for a reasonable period thereafter to fulfill legal and business obligations; service engagement records, including deliverables, audit reports, and related correspondence, are retained for at least three (3) years following completion of the engagement, consistent with the confidentiality and survival provisions of our Services Agreements; payment records are retained as required by applicable tax and accounting laws; and analytics data collected through Clicky is anonymized and retained in accordance with Clicky’s data retention practices.

You may request deletion of your personal information at any time by contacting us at the address provided below, subject to our obligation to retain certain data for legal, accounting, or security purposes.

Data Security

We implement reasonable administrative, technical, and organizational measures designed to protect the confidentiality, integrity, and availability of your information. These measures include but are not limited to: use of encrypted communications (HTTPS/TLS) across all Properties; access controls limiting data access to authorized personnel and contractors on a need-to-know basis; written confidentiality agreements with all contractors and service providers who access client data; secure payment processing through PCI-DSS-compliant third-party processors; and regular review of security practices and access permissions.

Given the technical nature of the data we handle in client engagements (accessibility issue descriptions, source code excerpts, WCAG evaluations, and similar technical information rather than sensitive personal data), the risk profile associated with our data handling is inherently limited. Nonetheless, we maintain security practices appropriate to the nature and sensitivity of all information in our possession.

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect your information, Accessible.org cannot guarantee absolute security and assumes no liability for any unauthorized access, disclosure, alteration, or destruction of information resulting from circumstances beyond our reasonable control.

Your Rights

Depending on your jurisdiction, you may have certain rights regarding your personal information, which may include the right to: access the personal information we hold about you; request correction of inaccurate or incomplete information; request deletion of your personal information, subject to legal and contractual retention requirements; request an exported copy of the personal data we hold about you; object to or restrict certain processing of your information; and withdraw consent where processing is based on consent.

For California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to request deletion of your personal information, and the right to opt out of the sale of personal information. For Users Outside the United States

If you are located outside the United States, including in the European Economic Area, United Kingdom, or other jurisdictions with data protection laws, please be aware that your information may be transferred to, stored, and processed in the United States where our servers and operations are located. By using the Properties or engaging our services, you consent to the transfer of your information to the United States, which may not provide the same level of data protection as your jurisdiction. If you are located in the EEA or UK and believe you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, please contact us to discuss how we can address your request. Our lawful bases for processing include performance of a contract, legitimate interests, and consent where applicable.

Children’s Privacy

The Properties are not directed at individuals under the age of 16, and we do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take reasonable steps to delete such information promptly. Third-Party Websites and Services

The Properties may contain links to third-party websites, services, or resources that are not operated by Accessible.org. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your interactions with third-party websites are governed solely by those third parties’ privacy policies. We encourage you to review the privacy policy of every third-party website you visit.

Do Not Track Signals

Our Properties do not currently respond to “Do Not Track” browser signals. However, as described above, our analytics configuration anonymizes IP addresses and does not set tracking cookies.

Limitation of Liability

To the fullest extent permitted by applicable law, Accessible.org shall not be liable for any unauthorized access to, disclosure of, alteration of, or destruction of your personal information, except to the extent caused by Accessible.org’s gross negligence or willful misconduct. In no event shall Accessible.org’s total liability arising out of or related to this Policy exceed the greater of one hundred dollars ($100.00) or the total amount paid by you to Accessible.org for services in the twelve (12) months preceding the event giving rise to liability. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to this Policy shall be resolved in accordance with the Dispute Resolution provisions of our Terms and Conditions.
